Insurance claims often run smoothly and the insurer is very helpful at an insured’s time of need.
However, a policy being a complex contract, there may be parts of the claim where the insured need assistance. This is often in preparation of the claim, which these days can be a technical and time consuming exercise for those not doing this sort of work regularly. It may include reviewing the policy documents, compiling schedules of loss, engaging qualified experts and/or dealing with the insurance company. With new relevant evidence, internal dispute resolution may produce just what the insured is looking for. Arbitration of the claim through the Financial Services Ombudsman usually requires compiling a special brief of evidence and expert opinion.
On some occasions, legal services are required, for example on interpreting exactly what the policy means when it comes to a specific claim and researching the statutes and similar claims as precedents set in the courts. When other alternate dispute resolution has failed, somtimes litigation is necessary.
